ZacApp Terms & Conditions

1. About these terms
These Terms govern purchases and use of ZacApp.
ZacApp is operated by Vizion Elevate Limited, company number 822159, whose registered office is at 55 The Green, Beaumont Woods, Beaumont, Dublin 9, D09 PK85, Ireland.
By placing an order, you enter into a contract with Vizion Elevate Limited.
Nothing in these Terms affects rights that you have under Irish consumer law.
2. Who may purchase ZacApp
Orders must be placed by someone aged 18 or over.
Where information about a child is supplied, you confirm that you are the child's parent or legal guardian, or that you have the appropriate authority to provide that information and request creation of the personalised app.
ZacApp is intended for personal and family use unless we agree otherwise.
3. The ZacApp service
ZacApp provides a personalised digital application created using information supplied during the order process.
Personalisation may include the child's first name, photograph and selected app options.
The exact features included in an order are those described on zacapp.ie at the time the order is placed.
Screenshots and demonstrations are intended to accurately represent the service, although minor visual differences may occur between devices.
4. Prices
The total price will be displayed before payment.
Where ZacApp offers an introductory price, launch offer, discount or other promotion, the conditions of that offer will be clearly displayed.
The current launch promotion may limit the introductory price to a specified number of qualifying paid customers. Once that allocation has been genuinely claimed, the standard price applies to subsequent eligible orders.
We will not create artificial or misleading scarcity.
5. Payment
Payment is processed securely through Stripe.
An order is not treated as paid merely because a customer reaches a checkout or payment page. Payment must be successfully confirmed by our payment system.
Following successful payment, we will send an order confirmation to the email address supplied.
6. Creation and delivery
Once payment has been confirmed, we begin preparing the personalised ZacApp.
The customer will receive confirmation that the order has been received.
When the personalised app has been reviewed and approved for release, we will send the customer the ZacApp link and any applicable Parent Zone code or access instructions.
Any estimated creation or delivery time displayed on the website is an estimate unless expressly stated to be a guaranteed deadline.
7. Information you provide
You are responsible for ensuring that names, email addresses, photographs and other information supplied to us are accurate and appropriate.
You must not upload content that:
- infringes another person's rights,
- is unlawful, abusive or inappropriate, or
- contains a photograph or personal information that you are not authorised to provide.
We may refuse or cancel an order containing inappropriate or unlawful material and will handle any refund in accordance with applicable law.
8. Child photographs and personalisation
A child's photograph and personal information are supplied solely for the purpose of providing the personalised service and associated support.
Supplying information for personalisation does not transfer ownership of your photograph to ZacApp.
We do not obtain a general right to use your child's image for advertising or promotional purposes.
9. Parent Zone and app access
Parents may receive an app link, Parent Zone code or other access credential.
These should be kept private.
You are responsible for people to whom you deliberately provide these credentials.
If you believe access information has been compromised, contact us and we will take reasonable steps to help secure the account or app.
10. One-time purchases
Where the product is described as a one-time purchase, this means there is no recurring charge for the base purchase unless a separate subscription or add-on is expressly selected.
A one-time purchase does not mean that every future ZacApp feature or additional product will automatically be supplied free of charge.
We intend to maintain access to purchased ZacApps on an ongoing basis, subject to reasonable technical, security and platform changes.
We do not describe the service as guaranteed “lifetime hosting”.
If the service is materially changed or discontinued, we will respect any remedies or rights required by applicable consumer law.
11. Device and internet requirements
ZacApp is a digital service and requires a compatible device, supported browser and internet connection.
Features and appearance may vary slightly between devices and operating systems.
Customers should follow any installation, browser or update instructions we provide.
12. Cancellation and refunds
Irish consumers generally have cancellation rights for contracts entered into online. Different rules can apply to personalised or customised digital content and services.
Because a ZacApp is created to the customer's specifications using information such as the child's name and photograph, the ordinary cancellation right may cease to apply once personalisation has begun where permitted by law.
Where the law requires us to obtain your express agreement before starting performance during a cancellation period, we will obtain the required acknowledgement.
This does not affect your statutory rights where ZacApp is faulty, not supplied, materially different from what was agreed or otherwise fails to comply with Irish consumer law.
Where a refund is legally due, it will be processed in accordance with applicable consumer law.
Irish CCPC guidance specifically recognises customised digital content/services as a category where ordinary cancellation rights may not apply, while separate remedies remain available when digital content is faulty or not supplied as agreed.
13. Problems with ZacApp
If your ZacApp does not work as described, contact hello@zacapp.ie.
We will try to resolve the issue within a reasonable time and without significant inconvenience.
Your statutory rights include remedies where digital content or a digital service is not supplied or does not conform to the contract.
14. Updates and changes
We may make reasonable updates necessary for security, compatibility, reliability, bug fixes or improvement of ZacApp.
We will not remove material functionality in a way that unlawfully reduces your consumer rights.
15. Intellectual property
ZacApp's software, graphics, games, branding, design and other original content belong to Vizion Elevate Limited or the relevant rights holder.
Purchasing ZacApp gives you a personal right to use the purchased personalised application.
It does not transfer ownership of ZacApp software or permit you to copy, resell, reverse engineer or commercially distribute it.
You retain rights in photographs and other material that you supply.
16. Educational content
ZacApp games and activities are intended for entertainment and informal learning.
They are not professional educational, psychological, developmental or medical assessments and should not be treated as such.
17. Promotions and competitions
ZacApp may occasionally operate competitions or promotional draws.
Each promotion may have separate rules dealing with eligibility, closing date, prize, entry requirements and winner selection.
Where separate promotion rules conflict with these general Terms in relation to that promotion, the specific promotion rules apply.
18. Liability
We provide ZacApp with reasonable care and skill.
We are not responsible for losses caused solely by matters outside our reasonable control or by misuse of ZacApp.
Nothing in these Terms excludes or restricts liability or consumer rights where Irish law does not allow us to do so.
19. Privacy
Our handling of personal information is explained in the ZacApp Privacy Policy.
Parents should read that policy before supplying a child's information or photograph.
20. Changes to these Terms
We may update these Terms as ZacApp develops.
Changes will not retrospectively remove rights already acquired under an existing purchase.
The current version will be available on zacapp.ie.
21. Irish law
These Terms are governed by Irish law.
Nothing in this section removes any mandatory consumer rights that apply to you.
