ZacApp Privacy Policy

ZacApp is a personalised digital application service operated by Vizion Elevate Limited, an Irish private limited company.

For data protection purposes, Vizion Elevate Limited is the controller of personal data processed through ZacApp.

2. What ZacApp does

ZacApp allows a parent or guardian to order a personalised digital app for a child.

The personalisation may include the child's first name, photograph and other choices supplied by the parent or guardian. The finished app may contain games, activities and other child-friendly content.

Parents are provided with access to their child's ZacApp and may also receive a Parent Zone code or other access credentials.

3. Information we collect

When you use ZacApp or place an order, we may collect:

  • Parent or guardian information: name, email address, contact details, account information and communications with us.
  • Child information: information supplied by the parent or guardian for the purpose of personalising the app, such as the child's first name and photograph.
  • Order information: product ordered, amount paid, order status, timestamps and references associated with the transaction.
  • Payment information: payments are processed by Stripe. We receive information confirming the payment and transaction reference, but we do not receive or store your full payment-card details.
  • App information: the personalised app created for the child, app link, Parent Zone information, app status and configuration.
  • Technical information: information reasonably necessary for security and operation of the service, such as IP address, browser/device information, security logs and error information.
  • Competition or promotional information: where you choose to enter a ZacApp promotion, we may collect the information necessary to administer that promotion.
  • Marketing preferences: whether you have separately agreed to receive promotional communications from us.

4. Children's personal data

ZacApp is designed for children but is purchased and managed by an adult.

Orders must be placed by a person aged 18 or over. A person supplying a child's information to ZacApp must be the child's parent or legal guardian, or have appropriate authority from the child's parent or legal guardian.

A child's photograph, name and other personal information remain the child's personal data.

  • We use children's personal data only to provide, personalise, operate, secure and support the ZacApp service.
  • We do not sell children's personal data.
  • We do not use children's photographs for advertising, social media, promotional material or unrelated purposes without obtaining separate, appropriate permission.
  • Where consent is the legal basis for processing a child's personal data and Irish law requires parental or guardian consent, we rely on the appropriate parent or guardian to provide that consent.

Parents or guardians can contact us to request correction or deletion of information relating to their child.

5. Why we use personal information

We process information where necessary to:

  • Perform our contract with you, including accepting your order, processing the purchase, creating the personalised app, providing access and delivering customer support.
  • Obtain consent, particularly where appropriate for the processing of a child's personal information, optional marketing or non-essential cookies.
  • Meet legal obligations, including accounting, tax, consumer-law and regulatory requirements.
  • Protect our legitimate interests, including preventing fraud, protecting the security of ZacApp, diagnosing technical problems and administering the business, provided those interests do not override the rights and interests of the people concerned.

We apply particular care where children's information is involved.

6. Photographs

Photographs uploaded for ZacApp are used for personalisation of the child's app.

Parents should only upload photographs they are entitled and authorised to provide.

We do not make uploaded photographs publicly available as part of a public gallery or marketing database.

The personalised ZacApp link and Parent Zone code should nevertheless be treated as private. Parents should not post them publicly or share them with people they do not want accessing the child's app.

7. Payments

Payments are processed using Stripe.

Stripe processes payment information under its own privacy and security arrangements. ZacApp receives information necessary to identify a payment, confirm its status, manage refunds and connect the payment to the correct ZacApp order.

ZacApp does not store full debit or credit card numbers.

8. Emails

We use email service providers, including Resend, to send transactional emails such as:

order confirmations, app-ready notifications, access information, Parent Zone information, support communications and other service-related messages.

Transactional emails are necessary for operating the service and are different from optional marketing emails.

We do not currently send marketing emails. If we introduce them in future, they will be optional, sent only where we have an appropriate lawful basis, and every message will include a one-click unsubscribe link.

9. Other service providers

We use trusted technology providers to operate ZacApp. These may include providers of hosting, databases, cloud infrastructure, email delivery, payment processing and security services. We do not currently use analytics or advertising providers.

These providers may only process information where necessary to provide their services to us and subject to appropriate contractual and data-protection arrangements.

Where information is processed outside the European Economic Area, we use appropriate safeguards required by data-protection law.

10. How long we keep information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected.

Information required to operate a child's active ZacApp may be retained while the app remains active.

If you ask us to delete an app, we remove the app and its game data. Photographs and order records are deleted manually on request to privacy@zacapp.ie, except where we must keep transaction records for tax purposes or where short-term backups have not yet expired.

Accounting and transaction records may need to be retained for six years in accordance with Irish tax-record requirements. Revenue currently requires businesses to retain relevant business records for six years.

We do not retain children's photographs simply because it might be useful to us in the future.

11. Security

We use reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, alteration or disclosure.

Access to administrative systems is restricted.

Parents are responsible for keeping their ZacApp links, login information and Parent Zone codes private.

No online service can guarantee absolute security, but we regularly review how information is protected.

12. Cookies and analytics

ZacApp may use cookies or similar technology that are strictly necessary for the website or app to function.

Where we use optional analytics, advertising or conversion-tracking technologies that require consent, they will not be activated until the appropriate consent has been obtained.

You will be able to change or withdraw applicable cookie choices.

Irish DPC guidance says analytics cookies generally require consent and that withdrawing consent must be as easy as giving it.

13. Your rights

Depending on the circumstances, data-protection law gives individuals rights including:

access to personal information, correction of inaccurate information, deletion, restriction of processing, portability, objection to certain processing and withdrawal of consent where processing is based on consent.

Children have data-protection rights in their own right.

A parent or guardian seeking to exercise a child's rights can contact us at privacy@zacapp.ie or hello@zacapp.ie.

We may need to verify identity or parental/guardian authority before releasing or changing information.

14. Complaints

If you have concerns about how we use personal data, please contact us first so we can try to resolve the issue.

You also have the right to complain to the Irish Data Protection Commission.

15. Changes to this policy

We may update this Privacy Policy where ZacApp changes or legal requirements change.

The current version will always be published on zacapp.ie together with its effective date.
